การยกเว้นทหาร
การยกเว้น มี ๒ ประเภท คือ
1. ยกเว้นไม่ต้องเข้ารับราชการกองประจำการ (ยกเว้นให้ตลอดไป) คือ
1.1 พระภิกษุที่มีสมณศักดิ์ หรือที่เป็นเปรียญและนักบวชในพระพุทธศาสนาแห่งนิกายจีน หรือ ญวนที่มีสมณศักดิ์ พระภิกษุที่มีสมณศักดิ์ หมายถึง ยศของพระ เช่น เป็นพระครู พระชั้นเทพหรือชั้นธรรม เป็นต้น ส่วนตำแหน่งของพระ เช่น เป็นเจ้าคณะจังหวัด เจ้าคณะอำเภอ อย่างนี้เป็นตำแหน่ง ไม่ใช่สมณศักดิ์ จึงไม่ได้รับการยกเว้น พระภิกษุที่มีสมณศักดิ์อาจไม่มีตำแหน่งก็ได้ พระภิกษุที่เป็นเปรียญ หมายถึง การศึกษา ของพระ เช่น เป็นเปรียญตั้งแต่ 3 ประโยค ถึง 9 ประโยค นักบวชในพระพุทธศาสนาแห่งนิกายจีนหรือญวน ที่มีสมณศักดิ์นั้น หมายถึง ผู้ที่บวชในพระพุทธศาสนาเหมือนกัน ต่างกันที่ถือตามนิกายของจีนกับของญวน นักบวชในพระพุทธศาสนาแห่งนิกายจีนหรือญวน ต้องมีสมณศักดิ์ด้วย จึงจะได้รับการยกเว้น
1.2.คนพิการทุพพลภาพซึ่งไม่สามารถเป็นทหารได้
2. ยกเว้นไม่เรียกมาเข้ารับการตรวจเลือกในยามปกติ คือ
2.1 พระภิกษุสามเณรซึ่งเป็นนักธรรม พระภิกษุสามเณรซึ่งเป็นนักธรรม หมายถึง ผู้ที่จบ นักธรรมตรี นักธรรมโท และนักธรรมเอก เมื่อยื่นเรื่องขอยกเว้นและได้รับการยกเว้นแล้ว ไม่ต้องไปแสดงตนเข้า รับการตรวจเลือกฯ ถ้ายื่นไม่ทันก่อนการตรวจเลือก จะนำหลักฐานไปยื่นขอรับการยกเว้นต่อคณะกรรมการ ตรวจเลือกในวันทำการตรวจเลือกก็ได้ หลักฐานที่ต้องนำไปยื่นต่อนายอำเภอเพื่อขอยกเว้น ได้แก่ – ประกาศนียบัตรจบนักธรรม – ใบสำคัญ(แบบ สด.9) – หมายเรียก(แบบ สด.35) – หนังสือรับรองของเจ้าอาวาส – หนังสือสุทธิ
2.2 ผู้อยู่ในระหว่างการฝึกวิชาทหาร (ยังไม่จบ รด.ปี 3) การขอยกเว้นให้สถานศึกษา จัดทำบัญชีผู้ซึ่งอยู่ในกำหนดต้องเรียกมาตรวจเลือกฯ ส่ง สำนักงานปลัดกระทรวงกลาโหม และ นรด. ภายใน เดือนตุลาคมของทุกปี หลักฐานเป็นหน้าที่ของกระทรวงกลาโหมจะแจ้งไปยังจังหวัดภูมิลำเนาทหารของผู้นั้น ให้จัดการยกเว้นให้ แล้วผู้นั้นไม่ต้องไปเข้ารับการตรวจเลือก
2.3 ครูในสถานศึกษา ครูซึ่งประจำทำการสอนหนังสือหรือวิชาการต่าง ๆ ที่อยู่ในความ ควบคุมของกระทรวง ทบวง กรม หรือราชการส่วนท้องถิ่น รวมถึงครูอัตราจ้างด้วย แต่ครูไม่ได้รับการยกเว้น ทุกคน ครูที่จะมีสิทธิได้รับการยกเว้นจะต้องเข้าลักษณะตามที่ก าหนด ดังนี้ เป็นครูประจำทำการสอนนักเรียน นิสิต หรือนักศึกษา ไม่น้อยกว่า 15 คนเป็นปกติ และในจำนวนนักเรียน นิสิต หรือนักศึกษาไม่น้อยกว่า 15 คนนี้ ยกเว้นครูได้คนเดียว หรือเป็นครูสอนประจำ เฉพาะวิชาซึ่งทำการสอนนักเรียน นิสิต หรือนักศึกษาไม่น้อยกว่า 15 คนเป็นปกติ และในจำนวนนักเรียน นิสิต หรือนักศึกษาไม่น้อยกว่า 15 คนนี้ ก็ยกเว้นครูได้คนเดียวเช่นกัน มีเวลาสอนสัปดาห์ละไม่น้อยกว่า 15 ชั่วโมง สำหรับครูซึ่งประจำทำการสอนในสถานศึกษาตั้งแต่ระดับมัธยมศึกษาลงมา หรือไม่น้อยกว่า 15 ชั่วโมง สำหรับครูซึ่งประจำทำกการสอนในสถานศึกษาระดับสูงกว่ามัธยมศึกษา
เอกสารขอยกเว้นทหาร
ข้าราชการครูและบุคลากรทางการศึกษาที่ประสงค์ขอยกเว้นเข้ารับราชการทหาร ให้แนบหลักฐานประกอบ จำนวน 2 ชุด ประกอบด้วย
- คำร้องขอยกเว้นการเกณฑ์ทหารฯ
- สำเนา สด.9 (ใบสำคัญ)
- สำเนา สด.35 (หมายเรียกเข้ารับราชการทหาร)
- สำเนา สด.43 (ใบรับรองผลการตรวจเลือกทหารกองเกินเข้ารับราชการทหารกองประจำการ)
- สำเนาทะเบียนบ้าน
- สำเนาบัตรประชาชน หรือสำเนาบัตรประจำตัวข้าราชการ
- สำเนาใบประกอบวิชาชีพครู
- สำเนาคำสั่งบรรจุและแต่งตั้ง
- หนังสือรับรอง
- บัญชียกเว้นการเกณฑ์เข้ารับราชการหทารตามมาตรา 14/ (5) แห่ง พ.ร.บ. เข้ารับราชการทหาร พ.ศ. 2497
- ตารางสอน (ต้องมีชั่วโมงสอน 18 ชั่วโมง หรือ 22 คาบ/สัปดาห์)
